Type of decision

Outcome
Application returned for filing before the Registrar of Trade Marks

Background

The applicants run a hospital under the name “M/s. Dr. Mubin Akhtar Hospital”. They applied to the High Court under sections 73 and 80 of the Trade Marks Ordinance, 2001 to revoke or invalidate the registration of that name as a trade mark in another person’s favour.

On the same day, the court returned their separate suit about the same registration for filing before the Intellectual Property Tribunal (see the related case). The court’s office objected that the application could not be filed in the High Court.

Questions before the court

  • Whether an application under sections 73(4) and 80(4) can be made to the High Court.
  • Whether a suit or proceeding concerning the mark was already pending in the High Court.

Decision

The court returned the application under Rule 119 of the Sindh Chief Court Rules (O.S.), read with Order VII, Rule 10 of the Code of Civil Procedure. The applicants must file their applications with the Registrar of Trade Marks in the form prescribed by the Trade Marks Rules, 2004.

The court’s reasoning

  • Under section 73(4), an application to revoke goes to the Registrar. It can go to the High Court only if proceedings about the mark are already pending there (Royal PVC (Pvt.) Ltd. v. Registrar of Trade Marks, 2011 CLD 833).
  • Section 80(4), read with section 116, works the same way for invalidation. As a Division Bench put it, “the intent of sub-section (4) of sections 73 and 80 is to avoid conflicting decisions by different forums” (H&B General Trading Company v. International Marketing Company, 2009 CLD 1028).
  • The pending suit the applicants relied on concerned a stake in a company, not the trade mark, and the suit just returned for the IP Tribunal could not count as pending.
  • The court noted, but did not decide, the argument that the IP Tribunal has taken the place of the High Court for these applications.

What this means in practice

Our comment

  • Revocation and invalidation of a registered trade mark normally start before the Registrar of Trade Marks, not the High Court.
  • If litigation about the mark is already pending, the application can be made in that forum, which avoids conflicting decisions.
